Terms of service

Version 1

Template — requires legal review

This is a working template describing how the software behaves. It is not legal advice and has not been reviewed by a lawyer. Have it reviewed and adapted to your jurisdiction, company structure and tax position before you sell subscriptions.

1. The service

Stampade provides software that lets a business run a digital loyalty program: designing a card, enrolling customers, recording stamps, and redeeming rewards. The service is provided on a subscription basis to the business named on the account.

2. Your account

You are responsible for keeping your sign-in details confidential and for what the staff accounts you create do. Staff can award stamps and redeem rewards, so remove access promptly when someone leaves. Each person must have their own account — shared logins make the audit trail meaningless.

3. Your loyalty program is yours

You set the stamp target, the reward and the terms, and you are responsible for honouring them with your customers. Stampade records the activity; it does not promise anything to your customers on your behalf. You are responsible for ensuring your program complies with any promotion, pricing or consumer-protection rules that apply to you.

4. Customer data

Loyalty customer data belongs to your business. We process it to run the service on your behalf, as described in the privacy notice. You are responsible for having a lawful basis to collect it, for the accuracy of what you tell your customers, and for honouring their rights. You can export your data at any time while your account is active.

5. Fees and payment

Subscription fees are as agreed when your account is set up. Fees are per business and do not depend on how many customers you enrol or how many stamps you issue. Any applicable local taxes are additional unless stated otherwise.

6. Late payment

If payment is overdue, your account continues at full function during a grace period. After that it becomes restricted: your data stays readable and exportable, and your customers can still redeem rewards they have already earned, but new stamps, enrollments and configuration changes are paused until payment is brought up to date. Data is not deleted because of non-payment.

7. Cancellation

You can cancel at any time. Cancellation takes effect at the end of the paid period, after which the account becomes restricted as described above. Export anything you want to keep before cancelling.

8. Wallet providers are outside our control

Apple Wallet, Google Wallet and Samsung Wallet are operated by Apple, Google and Samsung. Whether a pass can be issued depends on their approval, their terms, and the country the customer is in. We do not control and cannot guarantee their availability. The mobile web card is provided as the baseline and does not depend on them.

9. Acceptable use

Do not use the service to send unsolicited marketing, to collect data you have no right to collect, to attempt to access another business's data, or to probe or disrupt the service. We may suspend an account that does.

10. Availability

We aim to keep the service available and will give notice of planned maintenance where practical. No specific uptime figure is promised in these terms; if you need a service level commitment, agree it with us in writing.

11. Liability

The service is provided without warranties beyond those that cannot lawfully be excluded. The limits of our liability should be set out here in a form valid in your jurisdiction — this is one of the clauses that most needs a lawyer, so it is left deliberately unfinished rather than filled with wording that may be unenforceable.

12. Changes

If these terms change materially, the version number above changes and account owners are notified. Continuing to use the service after notice means accepting the updated terms.
